Guns N Roses To Sue Dr Pepper

Lawyers for Guns N' Roses have filed legal papers criticising the Dr Pepper Snapple Group over their botched Chinese Democracy promotion.

Lawyers for the band have demanded the Group take out full-page advertisements in a number of high-profile media outlets, including the New York Times and the Wall Street Journal, apologising for the difficulty caused by the campaign as well as extending the offer for a reasonable period of time.

Dr Pepper launched an unprecedented campaign last March, offering to send a free can of the drink to everybody in America if Guns N' Roses could produce the long-delayed Chinese Democracy album before the close of 2008. The album was, after fourteen years of on-and-off production, released on November 23, and Dr Pepper duly invited fans to sign up for a free coupon via the soft drink's website.

The promotion was due to last for 24 hours, until midnight EST on November 23. However, the company's servers were unprepared for the heavy increase in traffic and many were unable to sign up via the online form. The promotion was extended until 6 p.m. the following day, but many were still unable to register for their free coupon.

The lawsuit heavily criticises Dr Pepper for letting down Guns N' Roses' fans, and goes on to accuse the company of "exploitation of my clients' legendary reputation and their eagerly awaited album" and "brazenly violat[ing] our clients' rights." Dr Pepper is invited in no uncertain terms to seek to compensate Guns N' Roses for tarnishing its image, though no formal legal proceedings have yet been filed.

Interestingly, in March, a statement from singer Axl Rose on the band's website seemed to indicate the group was supportive of the campaign: "We are surprised and very happy to have the support of Dr. Pepper with our album Chinese Democracy, as for us, this came totally out of the blue. If there is any involvement with this promotion by our record company or others, we are unaware of such at this time. And as some of Buckethead's performances are on our album, I'll share my Dr. Pepper with him."

Axl Rose was unavailable for comment today.

HA! This is ridiculous. I applauded Dr. Pepper for actually following through with the deal, and now I scoff at Guns 'n' Roses' legal people for doing this.

I think that it is not fair that Dr. Pepper is being sued because of flaw with the internet, but the coupons should have been put on the site for longer than 24 hours. I understand that after the website crashed, the coupons were placed back up for 18 more hours, but that is still not enough time. Did'nt the company think that the website might crash again? The free coupons were also not advertised very well. I didn't even know that the coupons were being put on the website.
